Industrial Disease Claim - Case Study 1
We acted for a client who unfortunately was diagnosed at age 72, with active Mesothelioma about two years ago and died within a year.
His widow gave details of his working history which were traced back to the 1970's when he worked as a Plumbing Engineer in a Textile Research Establishment in the Midlands. His job was to re-lag pipes between laboratories in underground ducts in the days when no proper breathing equipment was available to avoid inhalation of the asbestos fibres. A detailed study of his other working history from documents researched, showed that the Research Establishment for which he worked ten years was the only source of the asbestos ingestion and eventually the insurers had to accept liability.
Damages were recovered as to £40,000 for the personal injury aspect and a Dependency Claim on behalf of the Widow and the Estate brought the total award up to £100,000.
