Mental Health Law

Mental health law is a specialist area. This has been recognised by the Legal Services Commission, who have granted franchises to those firms who have achieved the highest standards.

Our specialist team will, if necessary, help to complete your appeal papers, inspect your medical records and discuss those with you. If necessary, we will obtain the assistance of an independent psychiatrist to review and report on your case. We will assist you throughout the process and ensure that your opinions are heard.

At George Ide LLP, our Mental Health team is headed by Ian Oliver, a partner with ten years experience of mental health tribunals and a Member of the Law Society Mental Health Review Tribunal Panel. The department also includes Elizabeth Beaney a Legal Representative who is a member of the Mental Health Review Tribunal Panel.

How can we help you?

Being in hospital against your will (under Section) can be a lonely and frightening experience. As specialists in Mental Health Law, we are independent of the hospital and will fight for your rights. This service is always confidential and in most cases is free.

The decision to detain someone in hospital under Section should not be taken lightly. In most cases (Section 2 and 3) it will have been taken by two doctors and a social worker; in cases involving Hospital Orders (Section 37/41) it will have been taken by a Court. In all cases, the decision has been taken because those involved felt that you needed help that could only be provided in a hospital.

You may not agree with this decision or in some cases your condition may have improved. In this instance, you may wish to challenge the decision. We can help you do just that. You have a right to appeal against the decision to detain you.

What happens next?

There are several ways that you may be discharged from Section, depending which Section you are being held under. This is explained as follows:

Section 2

By your doctor

By the Hospital Managers

By the Mental Health Review Tribunal

Section 3

As above plus the following:

Your nearest relative may discharge you in certain circumstances

Section 37 (Hospital Order)

As in Section 2 above.

Section 37/41 (Hospital Order with Restrictions)

The Home Office may authorise your discharge

The Mental Health Review Tribunal may order your discharge
