Motorcycle Accident Claims Case Study 1

We acted for a motorcyclist who was thrown to the ground when a dog ran out in front of his motorcycle.

The motorcyclist suffered serious shoulder injuries, rendering his right arm and shoulder virtually useless. Research showed that there was a Local Authority Dogs Order in place restricting dogs to be kept on a lead and the domestic insurers of the premises from which the dog emerged whilst not actually insuring the dog did have to accept the negligence of the occupants who were the keepers of the dog in allowing it out on to the street and into the path of the motorcycle.

Damages for the serious shoulder injury agreed at £60,000, the remaining consequential losses for an active retail businessman brought the total award to £350,000.

Motorcycle Accident Claims Case Study 2

Mr L, a motorcyclist, was involved in an accident when his bike hit a large area of oil on the road. He suffered severe injuries, almost losing his leg. It became clear, from the outset, that the oil had been "dumped" on the road by the car driven by the first Defendant. However, it became apparent that the car may well have been fitted with a defective oil filter and therefore, given the fast approaching limitation period, it became necessary to issue proceedings against not only the driver of the vehicle, but the garage who serviced the vehicle and the UK concessionaires of the manufacturer, on the basis that the garage blamed them. Eventually, it became clear that the manufacturer/concessionaires had acted entirely properly and, in due course, the garage repairing the vehicle entered into negotiations in respect of the claim. Liability was admitted and accepted on a 75% basis. This case is ongoing.

Motorcycle Accident Claims Case Study 3

Mr C was riding his Harley Davidson motorcycle when he lost control and crashed. Mr C instructed this firm and alleged that the road surface was defective. We were able to investigate on his behalf and eventually able to identify other motorcyclists who had suffered similar accidents at the same location. Armed with this evidence we were able to persuade the Highway Authority to admit liability.

Mr C suffered quite significant ligament injuries, as a result of the accident, and it is unlikely that he will ever be able to ride a motorcycle again. Armed with the admission of liability we were able to recover the cost of repairing of his motorcycle, together with compensation for his injuries. The Highway Authority were also forced to repair the defective road.

Mr C's costs were paid the Defendant's insurers, by way of a Conditional Fee Agreement. He received 100% of his damages.
