Types of Personal Injury claim – Defective work vehicle accident

Our client succeeded in claiming against his employer on the basis that they were liable to him under the Work Equipment Regulations for defects in the steering and suspension system of the works van, with liability arising from the fact that the defect caused the van to veer out of control on to the wrong side of the road, causing him very serious injury.

We were able to establish liability from a combination of metal expert evidence confirming that there was an old fracture/breakage within the steering mechanism, and a reconstruction expert confirming that the way the vehicle went out of control was entirely consistent with sudden steering breakage.

There was strict liability on the part of our client’s employer for failing to ensure that the works van, and its parts, were maintained in efficient working order and in good repair.
