Injury compensation news – Claim against GP for delayed hospital treatment

The pensioner, who suffered a back injury after an assault in 2005, has taken legal action against the medical professional who treated him following the attack.

Lawyers for the claimant state that if their client had been sent to hospital by his doctor sooner, the long-term damage to his back would not have been as severe. They believe that the man, who has been left wheelchair-bound, would have retained a greater amount of mobility if it were not for the delay in receiving hospital treatment.

Although the GP has admitted failing to send the elderly gentleman to hospital straight away for further medical attention, his solicitors say that the lack of immediate action had no effect on the resulting severity of the pensioner’s disability.

According to the legal team working on behalf of the doctor, since the man suffered the personal injury a week earlier the extra 37 hours he had to wait before being referred to a hospital after his GP visit would not have made any difference to the outcome.

The 81-year-old is hoping to receive £1.3million in compensation after making his spinal injury claim.

The court case continues.
