The need for wills and probate solicitors

Over recent years there has been a growth in the demand for the expertise of wills and probate legal advice.

For the most part a will may be contested on the grounds that it is "unfair" Although these claims will often be spurious or fundamentally unsupportable. However, there are other, more clearly defined reasons, why a will might be contested, these include:

  • Undue Pressure – a person may contest a will if he or she believes that the testator was under undue pressure or influence when making it.

  • Lack of Mental Capacity – a will may be challenged if there are grounds to believe that the testator lacked full mental capacity at the time of its making.

  • Fraud – if a signature has been forged or given under duress or an original will tampered with, there will be strong grounds to challenge the document's validity.

  • Failure to Comply with the Wills Act – it is a legal requirement that a will is signed, dated and witnessed by two independent persons. Where rules have been breached, the will may be deemed invalid.

  • Claims for Financial Maintenance – Under the Inheritance Act, a person such as a wife or child can prove that she or he has not been properly provided for.
