SHORT MARRIAGE DIVORCE
Many people probably feel that if they have not been married for many years, their short marriage divorce will be carried out quickly. However, whether a couple has been married for two years or 62 years, the length of time it takes to process a divorce petition is the same.
Under English and Welsh family law, all couples must wait until 12 months after the date of their marriage or civil-partnership before they can commence divorce proceedings and, for the court to be able to grant a divorce, the applicant party, the petitioner, must prove one of five facts or grounds for divorce:
- That the other party has committed adultery;
- That the other party has behaved in a way that is unreasonable;
- That the parties have lived apart for at least two years and they both agree to a divorce;
- One party has deserted the other for at least two years;
- The parties have lived apart for at least five years.
In many cases, where a marriage has been short and there are no children of the union, the divorce will be straightforward, but a financial settlement will still require careful negotiation and expert legal advice.
