Family lawyers welcome same-sex marriage into family law

Many family lawyers have followed the passing of the controversial Marriage (Same Sex Couples) Bill through the Commons and House of Lords.

While many MPs saw the passing of the Bill as necessary to cement equality in law for all adults in England and Wales a number of opponents, including Conservative MP Sir Gerald Howarth, were vocal in their condemnation of the way the Bill had been “bulldozed” through Whitehall.

However, equalities minister Maria Miller said that marriage forms the bedrock of our society and the new law would see all British adults, irrespective of their sexuality, able to make that commitment to each other.

She added, “This is a historic moment that will resonate in many people’s lives. I am proud that we have made it happen, and I look forward to the first same-sex wedding by next summer.”

Following Speaker John Bercow’s announcement of the Queen’s assent in the chamber, the news was greeted with cheers in the House.

Family lawyers will be interested to see how, as time goes on, the inevitable same-sex divorces will be handled in law.
